When you visit this website or choose to access or use any of the tools or resources on this website you agree to such use being bound by these terms and conditions. If you do not agree with these terms, then you should not use or rely on any of the tools or resources of this website.

At any time these terms and conditions may be amended in whole or in part. Amendments to this website are effective immediately. It is your responsibility to keep up to date with the latest terms and conditions on the website. Continued use of the website is acknowledging you accept the terms that are in place at the time of use and any decision not to keep up to date with amendments or changes by you will not provide provision for liability to be transferred to Moneytrainer or any of its employees, representatives or any third party accessed through connecting from the Moneytrainer website.

We will not provide separate notice of changes or highlight / identify a specific change however we will always have appearing at the top of the Terms and Conditions the most recent date that applies. Please check this date and if you have not checked the Terms and Conditions since the shown date please familiarize yourself with the current Terms and Conditions that apply.
2 Terminology:
The following provides meaning to various terms and words used within these Terms and Conditions
“Tools” or “Resources” refer to any online calculators, articles or other information provided or accessible through this website
“Member” means a registered member of the website;
“Services” means those services offered through the website;
“Moneytrainer” means the Moneytrainer system;
“We”, “Us” and “Our” refers to Moneytrainer, its employees, contractors and licensees;
“You” or “Your” refers to you;

3 No Warranty or Liability:
3.1 Everything accessible through use of this website including but not limited solely to the tools, resources, services or products is provided by us to you or members of the website with the intention to assist you or its members in becoming better informed and therefore engage in well thought out financial habits or behavior. Your use of tools, resources, services or products available or obtained from this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.
3.2 We do not (and will not) provide to you or its members investment advice. It is important for you to be aware we DO NOT replace advice that you may need to seek (at your own cost) from independent 3rd parties such as (but not limited to) accountants, lawyers, brokers and financial planners.

You expressly agree that we not responsible or liable for any loss or damage caused (financial or other) due to discrepancies related to data entry and the consequential decisions that you make based on the use of the online calculators and tools, products and services. Due to the inability for us to ensure that all detail entered into our online calculators and tools are accurate and correct at the time of entry you acknowledge that this is done entirely at your risk. The results displayed are indicative only and should not be relied on without seeking further advice from either Moneytrainer or other professional advisers.
3.6 In situations where you seek further advice from us all reasonable endeavors will be made by us to assist you to become better informed in order that you can seek further professional or independent advice where it may be required however due to the vast variations in personal finances you also acknowledge that should further advice be undertaken from us that you indemnify us from any loss whether financial or other and that no liability or compensation shall be forthcoming or attributed to us.
3.7 Disclaimer: You expressly understand and agree that:
A. Responsibility for the content of advertisements appearing on this web site or any other communication we may make with you (including hyperlinks to advertisers’ own websites) rests solely with the advertisers. Such advertisements may appear from time to time on the web site or other communication however this in no way constitutes a recommendation or endorsement by us of the advertised product or service.
Each advertiser is solely responsible for any representation made in connection with its advertisement and product/service.
B. Refunds Policy:
(1) Careful selection of products or services available via this website is important. Please select carefully if you are intending on purchasing any resources, products or services as we have a “No Refund” policy. To the full extent permissible by law we do not provide any refunds in regard to payments received from you.
(2) Where payment has been made for reoccurring subscriptions or coaching services, payments are in advance (Unless agreed otherwise and form part of any contract) and cancelling your subscription or program prior to the next payment date simply ensures no further payment shall apply. You will still retain access to the full services available that relate to your paid subscription or coaching program for the remaining period of the pre-paid period therefore no refund is applicable.
(3) Except for B(2) above downgrading services will apply a credit of any unused payment to the new service and in the case of the new service being of lesser cost than the existing one the end date of the new service shall be extended out to such date necessary to use the credit created before commencing any future payments. You will be advised at the time of downgrading the new ‘End Date’ and next billing date.
Upgrading services will apply a credit of any unused payment to the new service and we will charge full payment necessary for the new service selected less any credit at the time of upgrade. You will be advised at the time of upgrading the new ‘End Date’ and next billing date.
C. Login Information: You are solely responsible for keeping your login information, including your password, secret and secure.
D. Banking Information: No bank account or credit card information is collected or stored on our system. With the exception of you choosing to pay by direct bank transfer all payment transactions for all services are performed through the “STRIPE” secured site and not through the Moneytrainer website.
E. Response time: We endeavour to respond as soon as possible however like every business from time to time we may be delayed in responding. If you have not received a response within our reply time (two working days) then please email us at [email protected]
4 General Provisions
4.1 Budget Planner results are not exact:
They are designed to represent a general picture of a user’s financial situation based on an ongoing collection of results through working with individuals and families. If you disagree your comments help us to adjust these. You are not required to comment however any feedback you do provide either by way of completing a survey, answering a specific question or other means will be done so with the need for any personal information that may identify you as optional.
4.2 System Integrity:
We will use its reasonable endeavors to ensure the availability of the web site and services, subject to any downtime required for maintenance. However, we do not take any responsibility for any system unavailability, or for any loss that is incurred by you as a result of web site or services being unavailable. We also accept no liability for any corruption of any data that you may have provided to us.
4.3 Force Majeure:
There is no liability on the part of us for any lack of performance, failure or availability of the services or the web site, where the same arises from any cause that can reasonably be seen to be beyond our control.
4.4 No Waiver:
If we do not enforce a right then this non-enforcement of such right does not constitute a waiver of any such right
4.5 Partial Invalidity:
In the event that these terms and conditions or any part of these terms and conditions is or are held to be illegal, unenforceable or invalid for any reason whatsoever then such part of the terms and conditions shall be deemed to be severed from the remaining terms and conditions and the remaining terms and conditions shall continue in full force and effect.
4.6 Governing Law:
These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.
4.7 Copyright and License to use:
The material on this website is protected by copyright. Copyright in all the information, products and services are held by Anthony William Hailwood. Permission is granted to you under a limited personal use license to access, display, download, format and print portions of this site content solely for your own personal non-commercial use, provided that the content is not modified and all proprietary notices are kept intact. You may not reproduce, publish, translate, merge, sell, rent, distribute the content, or create a derivative work of the content on any other website or as part of any educational, training or reference materials.

11. Competitions, prize draws and giveaways
From time to time we may offer prizes or giveaways and other promotions or competitions. By entering such events you acknowledge and accept the following.
11.1 In the event you are a winner you give permission for your name to be used for the purposes of notifying other participants of the winner. Such notification may be shared publicly on our website or in such other communication Moneytrainer uses for the purposes of keeping subscribers and members informed.
11.2 Your details will appear in the following format and no other details shall be shared without your express permission.

11.3 Winners will be notified within 3 days of the close date and Moneytrainer reserves the sole right to draw a new winner in the event the actual winner advises they do not want their name published. In such instances where Moneytrainer exercises this right the actual winner agrees to forfeit the prize won.
